Victims’ Rights Complaint Form
The Crime Victims’ Bill of Rights (CVBR) — found in Title 11, Chapter 94 of the Delaware Code — outlines rights that are upheld by different agencies across the justice system, including the Delaware Department of Justice. The DOJ may have influence over, or responsibility in, carrying out the victim rights listed below.
A victim or witness, or an individual on their behalf, can file a complaint if they believe these rights have not been upheld by the DOJ in a case where the crime is covered by the CVBR. (See 11 Del. C. § 9401(1) for covered crimes.)
The rights in the CVBR do not apply to all victims or all crimes. See 11 Del. C. § 9414(c)(1)b) and 11 Del. C. § 9401(1)) for full details.
