Substance Abuse Treatment Insurance Coverage Assistance Program

About the Program

The purpose of the Substance Abuse Treatment Insurance Coverage Assistance Program is to provide legal assistance to individuals who have private or public health insurance coverage (such as Medicaid and employer-sponsored health plans), but are encountering difficulties in receiving or maintaining coverage from their health insurance provider for medically-necessary substance abuse treatment.


Any Delaware resident who is covered by public or private health insurance, and who has been denied coverage or had coverage cut back or discontinued by their insurer regarding coverage for all or part of medically-necessary substance abuse treatment, is eligible to request free legal assistance from the Delaware Department of Justice in appealing the denial of that coverage.


In order to request assistance from the Delaware Department of Justice, individuals will need to provide the Department of Justice with health insurance and medical information and execute a medical privacy release so that the a determination can be made whether assistance can be provided and on what terms. Eligibility for assistance is not a guarantee that assistance or representation can or will be provided. Evaluating a request for assistance may involve referrals to or consultations with individuals, agencies, or organizations outside the Delaware Department of Justice, including licensed clinical social workers and potential legal counsel. If the assistance results in a referral to free private legal counsel, additional authorizations or releases may be necessary in order for that counsel to accept the engagement.

To successfully complete the application and medical privacy (HIPAA) release, please follow the steps below.

  1. Ensure you have Adobe Acrobat Reader prior to trying to save the documents to submit online. If you do not have Adobe Acrobat Reader, please find a free download for the software for the following devices: Desktop Computers | iPhone/iPad | Android |Windows Phone. This is the only platform that supports the online submission of the documents. If you are using a Mac/Apple computer or device, do not fill out the documents using Preview. Please use Adobe Acrobat Reader.
  2. Download the documents you would like to complete.
  3. Save the documents to your computer or device.
  4. Open the now-saved PDF’s in Adobe Acrobat Reader and complete them.
  5. Save the completed documents to your computer or device.

The application does not automatically save your information for your reference, even after you have downloaded it. In order to fill in the application and make necessary changes as you go along or after you submit it, you must save the application to your computer or device prior to inputting any information into it.

If you don’t have access to Adobe Acrobat Reader, you may download the form, print it out, complete the application, and mail, or scan it in to email it to the Department of Justice.
