Control's State Revolving Fund
Dear Secretary Minott:
You have asked whether the State of Delaware's Prevailing Wage Law, 29 Del. C. § 6912, applies to projects financed through loans from the Delaware Water Pollution Control Revolving Fund (hereinafter "the Fund"). For the reasons that follow, we conclude that the Prevailing Wage Law is applicable to contracts financed by loans from the Fund.
A review of the correspondence and attachments submitted with your request for an opinion indicates that, since 1990, the Department of Natural Resources and Environmental Control (hereinafter "the Department") has administered the Fund.
