Re: Escort Service Licensing

Dear Mr. Stango:

You have asked whether an escort service needs to be licensed by the Commission on Adult Entertainment Establishments (the "Commission") pursuant to 24 Del. C. ch. 16 (the "Act"). For the reasons stated below, we conclude that the Act does not apply to escort services, and therefore such services are not required to be licensed under the Act.

Before examining the Act to determine if the licensing of escort service is within its requirements, it is necessary to specify what is meant by an escort service. Neither your letter nor Delaware law offers a definition of the term. We understand, however, that the usual practice for an escort service is to have a telephone number listed without an address in the "Personal" column of a newspaper or in the advertising pages of a telephone
