FACTUAL BACKGROUND

On November 29, 1974, Mr. Reynolds committed first degree murder by stabbing Francis Benjamin Snyder to death. Attached as Exhibit A to this opinion are portions of the transcript of the trial judge's instructions to the jury. Pages 539 through 541 indicate the date of the offense was November 29, 1974;
