RE: National Voter Registration Act - 002
Dear Mr. Burke:
You have requested guidance regarding the removal of voters from the official list of eligible voters in light of the National Voter Registration Act ("NVRA") which governs elections to Federal offices. The NVRA outlines specific grounds for removal from the voter records. These grounds include registrant's request, criminal conviction, mental incapacity, death or change of residence. 42 U.S.C. §1973gg-6(a)(3) & (4).
Based on those grounds, attachments 1, 2 & 3 would be sufficient to remove those names from the official list under the NVRA. In all three cases, the registrants authorized or requested the cancellation of their voter registration. These forms are similar to the authorization found in 15 Del. C. §1707(a).
