THE
PROGRAM

The Summer Law Clerk Program offers law school students the opportunity to work with deputy attorneys general in almost every area of law in a professional and collegial environment. During the ten week program, law clerks rotate through the four Department of Justice Divisions – Criminal, Civil, Family, and Fraud and Consumer Protection.
The Attorney General has jurisdiction over all criminal prosecutions within the State as there are no district attorneys in Delaware. The Criminal Division prosecutes most misdemeanor and all felony crimes within Delaware. The Civil Division represents State agencies, commissions and boards in State and Federal Courts in nearly every area of civil practice. The Family Division oversees all aspects of civil and criminal law involving Delaware’s families and children. The Fraud and Consumer Protection Division investigates and prosecutes Medicaid fraud, consumer fraud, and securities fraud.
Clerks may conduct research projects, write memoranda of law, prepare briefs, and assist deputies in hearings and trials. Students are encouraged to explore their interest in litigation by attending court sessions and other legal proceedings. Qualified law clerks may have the opportunity to prosecute misdemeanor criminal cases.
To the extent possible, clerks are fully integrated into the work of the Department of Justice and thereby gain a realistic view of the rewards and demands of public service. Upon graduation from law school former summer clerks are given preference in our hiring process. Many of our current deputies began their relationship with the Department as summer clerks.

THE
HIRING PROCESS

Second Year Law Students
Approximately 8-10 2L law clerks will be hired for the summer program. Clerks will be placed in one of the three Delaware counties: New Castle, Kent or Sussex. Interviews for the program are conducted in the fall on several campuses and at various job fairs. If you are an interested 2L student, you should determine if our office will be coming to your school or a local job fair to interview and, if so, set up an interview for that time. Applications will also be accepted directly from students who are unable to interview at their school or at a job fair.
All 2L students applying for a summer law clerk position should include the following information with their application:
• Resume and cover letter
• Law school transcript
• Persuasive writing sample
Candidates are encouraged to apply early as offers will be extended beginning in December and continuing into the early part of the next year.
First Year Law Students
Positions for 1L students are limited and are unpaid. 1L students may be considered for a summer intern position or for an extern position during the school year. Availability of these positions will vary year to year. Interested students should include a resume, cover letter, and writing sample if available.
