ATTORNEY GENERAL’S OPINION ISSUED REGARDING
ELECTIONS IN CAPE HENLOPEN SCHOOL DISTRICT
(Wilmington, DE): Attorney General Carl C. Danberg announced today that his office has issued an Attorney General’s Opinion regarding whether Cape Henlopen School District violated Delaware law by offering a pizza party to the students in the school that turned out the most parent voters. The Report concludes that Cape Henlopen School District’s actions did not violate Delaware law and therefore are not subject to prosecution, however, where a school district simultaneously entreats parents of its students to vote yes in the referendum and informs the parents that those students have the opportunity for a reward if sufficient parents vote, the district creates an appearance of impropriety. Such conduct under undermines the public’s confidence in the election results, as well as school officials and should be avoided.
